Please read these terms and conditions carefully before using this site as they are a legally binding agreement between you and us.
These terms set out the rules for using our domain including our website: www.sakan.com, as well as any sub domain registered to Sakan.com and any Uniform Resource Locator (URL) or Application Programming Interface (API) by which Sakan.com’s data may be accessed (collectively referred to as the “Site”). Throughout this document we refer to these as the “Terms”. A reference to “you” or “your” is a reference to the user of this Site.
2.1. We are Sakan.com with our address at Kipco Tower, Al-Shuhada Street, Sharq, Kuwait City (referred to as “we,” “us,” or “our”). We are not a property sales or lettings agency. We are the providers of the Site. It is our members (which include estate agents, commercial agents, lettings agents, landlords and new home developers are referred to as “members”) that display property details for you to view.

2.3. We provide a platform for users to view property information uploaded by our members. We do not own, sell, or let properties listed on the Site and are not party to any transaction between users and members. We do not verify the accuracy of listings or the identity of members or users. You acknowledge and agree that your reliance on any information provided through the Site is at your own risk.
3.1. These Terms set out all of the rules and obligations that apply to your use of the Site.
3.2. By using our Site, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you must not use our Site.
3.3. You must be at least 18 years of age to use our Site. By using our Site and accepting these Terms, you confirm that you are at least 18 years of age.
3.4. We recommend that you download and store a copy of these Terms for future reference. They are a legally binding agreement between you and us.
3.5. These Terms may also refer to other policies, including our Privacy Policy and Cookie Policy, which also apply to your use of our Site.
4.1. We may amend these Terms from time to time by updating them on the Site. Every time you use our Site, please check these Terms to ensure you understand the terms that apply at that time.

5.3. To the fullest extent permitted by law, we disclaim all liability for any loss or damage arising from your use of the Site, reliance on information contained in it, or dealings with third parties.
5.4. Nothing in these Terms shall exclude liability for death or personal injury caused by negligence or for fraud.
6.1. You are solely responsible for ensuring that your computer system meets all relevant technical specifications necessary to use this Site and that your system is compatible with it.
6.2. You must not misuse our system or this Site. In particular, you must not hack into, circumvent security, or otherwise disrupt the operation of the Site, or attempt to carry out any of the foregoing. This includes introducing viruses, trojans, worms, logic bombs or other material which is or could be malicious or technologically harmful.
6.3. You must not use or attempt to use any automated program (including, without limitation, any spider or other web crawler) to access our system or this Site. You must not use any scraping technology on the Site.
6.4. You must not upload or use inappropriate or offensive language or content or solicit any commercial services in any communication, form, or email you send or submit from or to the Site.
6.5. Whenever you make use of features that allow you to upload content to our Site, or to make contact with other users via our Site, you must comply with the content standards set out in these Terms. You warrant that any such contribution does comply with the standards and, if you are a business, you will indemnify us against any breach of this warranty.
6.6. Unless you have prior written consent from our legal team, you must not:
7.1. To gain access to certain details and services on our Site, you will need to register (free of charge) as a Sakan.com user. You must be at least 18 years of age to register. At our discretion, we may refuse your application for registration.
7.2. Each registration is for a single user only. You must not share your username and password with any other person or with multiple users on a network.
7.3. You must ensure the password you use is unique and must not be re used elsewhere.
7.4. You undertake that all information provided by you for the purposes of registering with us is accurate and complete.
7.5. You accept sole responsibility for all use of and for keeping secret any password that may have been given to you or chosen by you for use on this Site. You will notify us immediately of any unauthorised use of them or any other breach of security of this Site of which you become aware.
7.6. We have the right to disable any account or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms.
8.1. We may suspend or terminate your access to the Site at any time, without notice, if you breach these Terms or if we reasonably believe your use of the Site poses a risk to us, other users, or third parties.
8.2. Upon termination, any rights granted to you under these Terms shall immediately cease.
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Kuwait.
You and we agree that the courts of Kuwait will have exclusive jurisdiction over any dispute arising from or related to these Terms.
